If WPMU DEV receives a DMCA takedown notice, we will inform the site owner regarding the same through the email associated with the Hub. If no further action is taken by the site admin, we are required to unpublish the reported content. However, the site owner can proceed with a counter-claim if warranted. WPMU DEV and its parent Incsub, LLC do not mediate any disputes between parties.

If you have received a DMCA takedown notice for content on your WPMU DEV hosted site, and that content has been unpublished, you can file a counter-claim to have your content restored if you are the legitimate copyright holder.

You must send the counter-claim to both the party who issued the takedown notice, and to WPMU DEV at [email protected]

For your convenience, below is a boilerplate template that you can customize for your counter-claim. Replace the values in square brackets [ ] with the correct information.

I have a good faith belief that the material removed or disabled following the Notice of Infringement was removed or disabled due to error or misidentification of the material. I therefore request that the material be restored and/or no longer disabled.

Note that if you are not a resident of the United States of America, you would want to replace point #3 in the above template with the following instead:

3. I consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which the claimant who submitted the Notice of Infringement resides, or as stipulated by the claimant. Furthermore, I agree to accept service of process from the person who provided the Notice of Infringement or their agent.
